Luminayre 200

Luminys agrees to repair or replace at its factory without charge any item which is returned, transportation prepaid, for inspection to Luminys’s factory, provided such inspection discloses to the satisfaction of Luminys that the any item is defective in material or workmanship or otherwise fails to meet the specifications.

Purchaser shall have the right to return such defective or nonconforming items to Luminys for correction or replacement.

Provided also that the item has not been altered or repaired by other than Luminys approved procedures, subjected to misuse, improper maintenance, negligence or accident damaged by excessive current or otherwise, had its serial number or any part thereof altered, defaced or removed, and provided that the Purchaser shall have notified Luminys of any defect or nonconformance within thirty (30) days after receipt of the items.

All prices are F.O.B. the Los Angeles facility of Luminys Systems Corp.  (“Luminys”). Purchaser assumes all risk of loss and responsibility for obtaining and paying for insurance and negotiating with the carrier and/or insurer in the event of mistaken or misdirected delivery, loss or damage, regardless of the fact that insurance may have been secured by Luminys at Purchaser's request.

All freight charges will be paid by the Purchaser.  In the absence of specific instructions, Luminys will ship by what it deems to be the most appropriate method
